why haven't you used eminent domain to yoink the tracks from freight companies so they can actually be repaired and modernized to add stuff like higher speeds and electrification and the like? I'm fairly sure it's something to do with the government being a bitch, but is it a funding issue or the policy being unpopular or is there some legal loophole freight companies would try to use? Or am I misunderstanding something on a fundamental level and eminent domain wouldn't even apply at all?
